Employee Relations (ER) involves work that is focused on supporting, promoting, and facilitating fair and productive employee/employer relationships. The role of ER involves working with the respective SMEs to review / create ER or ER related policies; providing guidance / advice on procedures and policies on matters related to ER or can give rise to ER implications (e.g. workplace conflicts, complaints, performance appraisal disputes, absence management, disciplinary actions/consequence management, exit management/business re-structuring); leading/managing internal investigations on complicated matters arising from PCC (personal misconduct) and employee grievances or advising the HR Advisory team on management of the less complicated PCC and grievance cases; overseeing cases involving the Labor authorities/regulators; provide various reports on management information relating to PCC and grievance; analytics to identify trends and areas of significant people / HR risks.
**In this role, you will**:
- Maintain a high level of integrity & confidentiality at all times
- Develop effective relationships with the business to promote good employee relations across HSBC
- Manage internal investigations on MENAT matters arising from Personal Conduct Cases, employee grievances and complaints, performance related disputes, whistleblowing and other workplace issues in line with HSBC protocols at a regional level and support with cross border investigations.
- Manage some cross regional investigations, including from Europe, as needed.
- Facilitate coaching for HRA, HRBPs and HRCs in areas of employee relations practices where necessary.
- Support line management by providing advice and guidance on disciplinary, capability, grievance and coach managers where appropriate
- Support in the provision of advice and guidance on business change, reorganization & restructuring activity including redundancies, insourcing, outsourcing employee terms and interpretation of policy
- Provide advice and guidance on conduct considerations related to requests to rehire former employees
- Provide advice and guidance on cases of dismissal/ termination of employment and liaise with Legal and Regulatory Compliance to ensure compliance with law.
- Produce various reporting on ER matters/MI including for governance forums as needed (e.g. People Committee, HR Business Partner reports, RCMM Reporting, UAE HSBCC tracker, CEO case summaries, HSBCC bi-weekly reports, and RC OpCo Committee on HSBCC, and Service Level Management)
- Build and Maintain external and internal stakeholder relationships across the region, including with, Immigration, Labor office, Health Authority and other ER leads in other market sectors as well as HR generalist, Legal, FCTM, Regulatory Compliance.
- Support in creating, reviewing, refining ER / employment policies and operating procedures and ensure they comply with Regional legal requirements and Group FIM. Embed policies and evaluate policy effectiveness
- Be up-to-date with regional employment laws to ensure HSBC, management and employees are in compliance
- Be up to-date about Employee Relations Framework and new ways of working changes.
- Participate in HR projects as required
- Support the Senior ER role holder in MENAT in all ER aspects as and when required.
- Support hearings under the bank’s disciplinary and grievance procedures, ensuring that decisions made comply with both internal and external spirit of the procedures to mitigate the risk of potential litigation and or cost impact.
- Work in partnership with Employment Legal to provide guidance to key stakeholders on any employment related litigation. Ensure that all newly created and existing employment policies and procedures do anticipate and meet the legal requirements and Market practice.
- Support line management by providing advice, guidance and direction in relation to employee relations and employment law to make the decisions for all ER related matters.
- Conduct L2 Regional Quality Assurance on HR/ER investigations in MENAT countries
- Support on People Risk controls operated by ER
- Support on Industrial Relations matters in MENAT region as needed
Requirements
**To be successful in the role, you should meet the following requirements**:
- Project management
- HR and Employee relation experience
- University degree is mandatory
- English - Excellent in both spoken and written. Written/Spoken Arabic will also be an advantage.
- Experience with country law and labor relations within the UAE, and strong knowledge of Middle East culture
