KEY RESPONSIBILITIES:
Assist/Manageallactivitiesrelatedtopostawardoncontractual,legalandcommercialissuesrelatedto:
Contracts with Clients. Subcontracts and Procurement. Joint Venture and partnering agreements. RiskandOpportunityreviewprocessincluding,identification, mitigation andmanagement of commercial/contractual/legal risks. Contract variations and claims.Primary Duties
Supportsandmanagesallactivitiesrelatedtoadministrationofassigned contracts including correspondence with clients and partners, provision of commercial / contractual inputs for project review meetings, liaison with engineering, project, site, subcontracts and procurement teams to identify potential variations and claims, preparation and submission of variations and claims, risk identification, risk mitigation risk management during the post award stage. Perform contract lifecycle management in accordance with company processes and procedures. Develop project-specific special terms and conditions for subcontracting and procurement. Provide support to Subcontracts and Procurement for negotiating terms and conditions of downstream contracts. Liaise with Insurance for the issuance of project insurance certificates to Clients and for submission of claims to insurer. Liaise with Treasury for issuance of performance bank guarantees to Clients. Liaise with Legal to prepare legal/contractual positions on disputed claims and variations with Clients / Subcontractors / Vendors. SupporttheCommercialDirectorinthenegotiationofvariationsandclaims withClient.AssisttheCommercial Directorandproject /commercialteammembersincompilingsupportingdocumentsforpotentialclaims, preparing advance defense for issues that are likely to evolve during execution phase. Assist,evaluateandadviseCommercial Directoroncontractualconflictsandclaimswithclients. In the event of a dispute, advise on the company’s position, information required in defenseof or in pursuance of such. Toreviewonaregularbasis,company’spositionafterevaluatingreportsreceivedfromtheprojectteam in respect of discrepancies, anomalies, risk and opportunities and take necessary action. Assistinmanagingallactivitiesrelatedtocontractual,legal,tax,commercialandinsuranceissuesrelatedtocompanybusiness,contractswithclientsandpartneringagreementsduringthepostaward stage. Maintain commercial / contractual database in accordance with company procedures and processes. AssistinensuringthatthekeycontracttermsandconditionsarepresentedandunderstoodbytheProjectManagementandCommercialTeamuponawardoftheContract.ESSENTIAL QUALIFICATIONS AND SKILLS:
A graduate university degree in Engineering or Business Administration. Experience in tendering, finalization, administration and management of Contracts and in finalization of various Partnership Agreements.#LI-BS1
