Roles and responsibilities

1. Legal Expertise&Knowledge

  • LitigationExpertise : Strong understanding of civil procedure,courtroom procedures, and the litigation process, including filingmotions, preparing briefs, managing discovery, and presentingarguments.
  • Alternative DisputeResolution (ADR) : Knowledge of ADR methods such asmediation ,arbitration , andnegotiation , which are often used toresolve disputes outside ofcourt.
  • Dispute ResolutionMechanisms : Understanding the various disputeresolution mechanisms, such as international arbitration,settlement negotiations, and judicial review, to choose the mosteffective method based on the client'sgoals.
  • LegalResearch : Conducting thorough legal research intocase law, statutes, and regulations relevant to a case, andadvising clients on legalstrategies.

2. ClientInteraction &Advisory

  • ClientConsultation : Meeting with clients to understand thenature of their disputes, advising them on legal options, andexplaining the pros and cons of different resolution approaches(litigation vs. ADR).
  • StrategicAdvice : Providing guidance on the best strategy toresolve a dispute, whether it's taking the matter to courtor exploring mediation orarbitration.
  • CaseManagement : Managing client expectations throughoutthe dispute resolution process, providing regular updates, andensuring that the client's needs areprioritized.
  • Confidentiality& Trust : Maintaining confidentiality whilehandling sensitive client matters, and ensuring trust throughoutthe dispute resolution process.

3.NegotiationSkills

  • SettlementNegotiations : Leading or participating in settlementnegotiations to reach a favorable resolution for the client withoutresorting to litigation or furtherconflict.
  • Drafting SettlementAgreements : Drafting clear and enforceablesettlement agreements that resolve disputes and meet theclient'sinterests.
  • Mediation andArbitration : Participating in or representingclients in mediation and arbitration proceedings to reachresolutions outside of the courtsystem.
  • Collaborating withOpposing Counsel : Negotiating with opposing counselto resolve disputes amicably, balancing assertiveness withprofessionalism.

4.Litigation Support & CourtRepresentation

  • CourtFilings & Pleadings : Drafting and filinglegal documents such as complaints, motions, briefs, and pleadingswith the court, ensuring compliance with proceduralrequirements.
  • Discovery &Evidence Gathering : Managing the discovery process(e.g., collecting evidence, deposing witnesses, and reviewingdocuments) to build a strong case for trial orsettlement.
  • TrialPreparation : Preparing for trial by organizingevidence, drafting witness statements, creating exhibits, andcoordinating with expertwitnesses.
  • CourtAppearances : Representing clients in court hearings,settlement conferences, and trials, arguing motions, presentingevidence, and cross-examiningwitnesses.

5. CaseStrategy & RiskAssessment

  • RiskAnalysis : Assessing the merits of a case,identifying potential legal risks, and advising clients on thelikelihood of success or failure in litigation orADR.
  • Strategic CasePlanning : Developing and implementing effectivelegal strategies based on case facts, legal principles, and clientgoals.
  • Budgeting & CostManagement : Managing the costs associated withlitigation or dispute resolution, including estimating legal fees,court costs, and the potential cost-benefit analysis of going totrial vs. settling.

6.Document Drafting & LegalWriting

  • LegalDrafting : Drafting legal documents such ascomplaints, motions, responses, settlement agreements, andarbitration briefs that are clear, concise, andwell-reasoned.
  • Legal Writing forADR : Writing persuasive documents such as mediationstatements, arbitration submissions, or pre-hearing briefs thatoutline the legal arguments in favor of the client'sposition.
Desired candidate profile

The workwill include drafting and reviewing cases in Arabic on disputesrelated to Real Estate Disputes, Civil Disputes, ConstructionDisputes, Maritime Disputes and Aviation Disputes. In addition, TheDispute Resolution Associate will be managing and training the moreJunior and Mid-Level Associates in the team.

To be considered for this role, the idealcandidate will be excellent in Arabic drafting, based in the UAEand have been in a managerial position for a minimum of 3years.

  • CourtAppearances : Represent clients in hearings,depositions, and settlement conferences, and prepare trial exhibitsand witness testimony for courtproceedings.
  • ClientUpdates : Regularly communicate with clientsregarding case status, timelines, and strategy updates, keepingthem informed and involved in the decision-makingprocess.
  • SettlementNegotiations : Lead or assist in negotiatingfavorable settlements for clients and drafting settlementagreements to avoid lengthytrials.
